Terms of Service

1. The Service

HoopIQ (“we,” “us,” or “our”) operates the website hoopiq.io and related services (the “Service”). The Service provides NBA player prop analytics, statistical data, hit rates, value assessments, and related informational content.

HoopIQ is not a sportsbook, gambling operator, or licensed betting service. We do not accept wagers, process bets, or facilitate gambling transactions of any kind. All content is for informational and entertainment purposes only.

2. Eligibility

You must be at least 21 years of age (or the minimum legal age for sports betting in your jurisdiction, whichever is higher) to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations in your jurisdiction.

3. Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account at support@hoopiq.io.

We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these Terms.

4. Subscription Plans & Billing

Free Tier

The free tier provides access to limited features including tonight's games dashboard, Top 5 daily prop picks, basic player prop cards, player search, and injury status indicators. No payment is required.

Pro Subscription ($9.99/month or $79/year)

The Pro tier provides access to the full Decision Card analytics suite, Prop Explorer, advanced splits, line movement tracking, risk meters, opponent context engine, and all other premium features. Pro subscriptions include a 7-day free trial for new subscribers.

Billing

• All payments are processed securely by Stripe. We do not store your credit card information.
• Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.
• You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — you retain Pro access until then.
• We do not offer refunds for partial billing periods. If you cancel mid-cycle, you will continue to have access until the end of the period you have already paid for.
• We reserve the right to change subscription pricing with 30 days' notice. Existing subscribers will be notified via email before any price change takes effect.

Failed Payments

If a payment fails, we will attempt to process it again using Stripe Smart Retries. If payment cannot be collected after multiple attempts, your subscription may be downgraded to the free tier. You will be notified via email before any downgrade occurs.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
• Scrape, crawl, or use automated tools to extract data from the Service without our written consent
• Redistribute, resell, or commercially exploit the Service or any data obtained from it
• Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our systems
• Interfere with or disrupt the Service, servers, or networks connected to the Service
• Use the Service to send unsolicited communications or spam
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Share your account credentials with others or allow multiple individuals to use a single account
• Circumvent, disable, or otherwise interfere with security features of the Service, including subscription tier gating

6. Intellectual Property

The Service, including its design, code, analytics methodologies, content, logos, and branding, is owned by HoopIQ and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use in accordance with these Terms. This license does not include the right to modify, reproduce, distribute, or create derivative works based on the Service.

NBA statistics and player data are sourced from third-party providers and are subject to their respective terms and licenses. Team names, logos, and related marks are trademarks of their respective owners and are used for identification purposes only.

7. Not Financial or Gambling Advice

You acknowledge that you use any information from the Service at your own risk and that HoopIQ bears no responsibility for any gambling decisions you make based on our analytics.

8. Data Accuracy

While we strive to provide accurate and timely information, we make no warranties or representations regarding the accuracy, completeness, or reliability of any data, statistics, or analytics provided through the Service. Data is sourced from third-party providers and may contain errors, delays, or omissions.

Always verify information independently before making any decisions. Prop lines, injury reports, and game schedules are subject to change without notice.

9. Limitation of Liability

To the fullest extent permitted by law, HoopIQ and its operators, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from:

• Your use of or inability to use the Service
• Any errors or omissions in the Service's content or data
• Losses from gambling activities informed by data on this platform
• Unauthorized access to or alteration of your data
• Any third-party conduct on the Service

In no event shall our total liability exceed the amount you have paid to HoopIQ in the twelve (12) months preceding the event giving rise to the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless HoopIQ, its operators, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, either party may pursue binding arbitration in accordance with the rules of the American Arbitration Association (AAA).

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against HoopIQ.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

12. Account Termination

You may delete your account at any time by contacting support@hoopiq.io. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

We reserve the right to suspend or terminate your account, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if required to comply with legal obligations. If your account is terminated for a violation, you are not entitled to a refund of any subscription fees.

13. Third-Party Links & Services

The Service may contain links to third-party websites or services, including sportsbook affiliate links. These links are provided for convenience only. HoopIQ does not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party sites or services.

Your interactions with any third-party service, including sportsbooks, are solely between you and that third party. HoopIQ is not responsible for any losses or damages arising from your use of third-party services.

14. Modifications to the Service & Terms

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last Updated” date. If we make significant changes to subscription terms or pricing, we will also notify you via email. Continued use of the Service after changes constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
